TYPOGRAPHICAL ERRORS
In the event a product is listed at an incorrect price due to a typographical
error or error in pricing information contained in an advertisement Tell
City Chair Company shall have the right to refuse or cancel any orders
placed for product listed at the incorrect price. Tell City Chair Company
shall have the right to refuse or cancel any such orders whether or not
the order has been confirmed and your credit card charged. If your credit
card has already been charged for the purchase and your order is canceled,
Tell City Chair Company shall immediately issue a credit to your credit
card account in the amount of the incorrect price. In the event that
information about a product listed contains a typographical error you
agree that the sole and exclusive maximum liability to Tell City Chair
Company arising from any product sold by Tell City Chair Company shall
be the price of the product ordered. In no event shall Tell City Chair
Company, its directors, officers, employees or other representatives
be held liable for special, indirect, consequential, or punitive damages
related to product sold.
DISCLAIMER AND LIMITATION OF LIABILITY OF PRODUCTS SOLD
All products offered for sale in the TELL CITY DIRECT™ WebPages
on the Tell City Chair Company website may be returned for a period of
15 days from the date of the shipment subject to the terms and conditions
of the return policy. Except as expressly stated herein, Tell City Chair
Company makes no representations or warranties, either express or implied,
of any kind with respect to products on the Tell City Chair Company website,
including but not limited to, merchantability and fitness for a particular
purpose. You agree that the sole and exclusive maximum liability to Tell
City Chair Company arising from any product sold shall be the price of
the product ordered. In no event shall Tell City Chair Company, its directors,
officers, employees or other representatives be held liable for special,
indirect, consequential, or punitive damages related to product sold.

Tell City Chair Company shall have no liability for: 1. Any loss or injury
caused, in whole or in part, by its actions, omissions, or negligence,
or for contingencies beyond its control, in procuring, producing, or
delivering services, products, information, or data on the Tell City
Chair Company website; 2. Any errors, or omissions, or inaccuracies in
the services, products, information, or data on the Tell City Chair Company
website, regardless of cause or origin, or delays or interruptions in
delivery of goods or services, information or data; or, 3. Any decision
made or action taken or not taken in reliance upon the goods and services,
information or data furnished herein under. You agree that this limitation
of liability is comprehensive and applies to all damages of any kind,
including without limitation, direct, indirect, compensatory, special,
incidental, punitive and consequential damages.
PRODUCT RETURNS
All products to be returned must have a return authorization number (RMA) before
they can be returned. Please contact us for your Return Authorization by telephone,
1-800-214-6077,by E-mail at info@tellcitychair.com,
or, by fax at 1-812-547-6977, and be sure to provide a daytime telephone number
so that we can contact you. Please have your Order Number when you call us for
a return. The order number can be found on the packing slip that was sent
with your product. We will issue a return authorization and make arrangements
to have the product returned to us. Credit will be issued upon receipt
of the returned item in good condition. See return policy for details.
RETURN POLICY
We want you to be satisfied with your purchase and accept returns of
product for credit within 15 days from the date of shipment. A Return
Authorization is required before you can return your purchase.
All returns are subject to a 10% restocking fee. Product must
be returned in its original carton with the inner pack as it was received. If
the condition of the returned item and packaging is not complete, and
the returned item is not in it’s original delivered condition
we reserve the right to increase the restocking fee. All returns must
have a Return Authorization from us before they can be accepted. You
may request a return authorization by telephone, fax or via e-mail,
but be sure to provide a daytime telephone number so that we can contact
you. Any items returned to us without a return authorization
will be refused. We cannot accept COD or freight collect shipments
under any circumstances. Return instructions are provided on the packing
slip included with your order. Please follow those instructions
to make your return. Any items returned to us without a return
authorization will be refused. The cost to insure and ship the
item to us will be your expense. Please contract us to arrange
return pick up service via Fed-Ex Ground or Fed-ex Home Delivery to
avoid additional restocking fees.
SALES TAX
Tell City Chair Company shall automatically charge and withhold the applicable
sales tax for orders sold directly to consumers by Tell City Chair Company
for delivery within the state of Indiana. Each customer shall be solely
responsible for all sales taxes, or other taxes, on all other orders.
JURISDICTION AND VENUE
You agree that any legal action brought against Tell City Chair Company,
its shareholders, directors, officers, employees, agents, attorneys or
other representatives, shall be governed by the laws of the State of
Indiana without regard to its conflict of law principles. You agree that
the sole jurisdiction and venue for any litigation arising from your
use of the Tell City Chair Company website or its conduct of business
shall be an appropriate federal or state court located in the seventh
Federal District.
